REPORT ON THE SB 1312 HEARING |
|
Following is our report on the April 14, 2008 Senate Business, Professions and Economic Development Committee
hearing on SB 1312.
SB 1312 received the bare minimum number of votes to stay alive and move next to the Appropriations Committee in the Senate. The Committee held nearly a two hour hearing on the bill, giving both sides considerable time to present their
case and rebut the other's arguments. Carol Lamkins (CLCID) and Scott Westby (CKD) did a very good job along with Mark Christian from AIA and Ruth Cross representing the lumber industry. In addition, nearly thirty
additional witnesses on CLCID's side were given the opportunity to briefly testify in opposition. CLCID and NKBA members did an excellent job and should be commended. The proponents were led by Bruce Goff and given the
same opportunity and had about the same number of witnesses. The proponents included the head of the NCIDQ who tried to explain his exam to the committee members.
Also present were Douglas Stead, VP/Executive
Director of CCIDC and Robert E. Wright, CCIDC Public Board Member and Board Secretary. They answered questions posed by Senator Tom Harmon concerning the CID certification and the differences between the NCIDQ
exam and the CCRE certification exam.
Senator Yee described the bill as a "work in progress" and said he never has intended to
put anyone out of work and will work with the opposition on their concerns.
The vote was taken on the bill and the vote was 4 aye's and 3 no's, with five votes needed for passage, so the bill was "put on call" waiting for absent members to come in to vote.
Even though the bill
was heard in the mid afternoon, the final vote was not taken until about 6:00 PM when absent Senators returned to the committee to vote. Senator Simitian returned first and declined to vote. Senator Ellen Corbet
came in a few minutes later and, after making a statement that the author had assured her that he was working with the opposition and wouldn't put anyone out of work, voted for the bill with the understanding that the
bill would be returned to the committee for review of any compromise between the parties.
The final passage of the bill out of this committee was 5-3, with one abstention.
CLCID believes SB 1312 would have a negative impact on the California economy
as it is a restrictive, anti-competitive and anti-consumer bill. Despite what opposition claims, additional taxpayer funding would be necessary to implement and enforce SB 1312.
CLCID believes in a free and open market, and SB 1312 is an attempt by a handful of designers to corner the market and limit the ability of the consumer to choose the designer who best meets their needs and budget.
CLCID supports the Certification Law as administered by CCIDC. You can help by continuing to voice your opposition to restrictive design legislation
and letting your clients and colleagues know about this harmful bill. Thanks to everyone
