I’d like to take this opportunity to thank our Past President, Ms. Linda Johnston Panattoni for her leadership and our Past Board Executives for their dedication and service to CLCID members.CLCID has continued to represent your business concerns with government agencies, officials and consumer groups. However, our climate needs a major change “Legislation”. By definition, it is the preparation and enactment of laws, a process that is an important part for the interior design community. CLCID’s “Legislative Watch” monitor’s issues that restricts your right to improve the living, working, and recreational environment of California residents. Also, supports the existing “Certified Interior Designer” tittle protection and the qualifying exams and standards of professionalism.

While 2012 sets new challenges for our members and affiliate organizations. Economic times have impacted tremendously our interior design community, affecting virtually every residential and commercial interior design business, manufacturer, supplier, dealer and interior design school in California. CLCID is also a non-profit 503-C3 and relies on your contributions to fight for your rights.

You can support CLCID by becoming a member, a Benefactor (tax deductible donation) or by purchasing the CA CODE’s and Regulations Reference Manual for Interior Designers. You can also help CLCID protect your rights as a unified voice. As stewards, you can make a difference, you can help bring change or prevent change, become more involve with your local government officials! Let them know about your duress! Address issues that can offer some relief or a pathway to recovery for your business. For instance, your district Assembly member can be very instrumental in Sacramento, incentivizing our community with rebate incentives for consumer goods, tax deduc -tions, building permits, etc… Meet your Assembly member; they can also make a difference!

CAL Green Standards Codes: 2012 International Energy Conservation Code (IECC)

      Ventilation Fan Efficiency

     When installed to function as a whole-house ventilation system, the IECC specifies that mechanical fans
     meet the following requirements.

  • Range Hoods and In-Line fans: 2.8 cfm/watt
  • Bathroom (10-90cfm): 1.4 cfm/watt.
  • Bathroom (>90cfm): 2.8 cfm/watt

     The 2012 IECC now places upper limits on the energy requirements for these fans where there were no
     such limits in the 2009 IECC., this change is expected to improve the overall efficiency.

     Wall Insulation When Structural Sheathing is used

     The 2012 IECC states: “First value is cavity insulation, second is continuous insulation, so “13+5” means
     R-13 cavity insulation plus R-5 continuous insulation. If structural sheathing covers 40 percent or less of
     the exterior, continuous insulation R value shall be permitted to be reduced by no more than R-3 in the 
     locations where structural sheathing is used – to maintain a consisten total sheathing thickness.

Air Duct System

       Section R 403.2.2 reduces maximum allowable levels of duck leakage in the distribution system compared
       to the 2009 IECC (from 12 cfm per 100ft square of conditioned floor area to 4CFM/100FT 2 for tests done
       on completed buildings, and from 6 to 4cfm per 100ft 2 for tests done at the rough-in stage of construction).

Hot Water Pipe Insulation and Length Requirements

       New specifications for non-circulating service hot water distribution systems that should reduce energy 
       losses from “stranded” hot water and conduction of heat out of the pipes. The 2012 IECC specifies that all
       such pipes to be insulated unless they have sufficiently low volume as defined by a combination of their
       length (measured from the tank or distribution manifold to the point of use) and diameter. This change is
       expected to reduce the amount of hot water that cools off in the pipes and is thus wasted as users wait for
       sufficiently warm water to reach the fixture.

        Also, the circulating hot water system, the required insulation has been increased from R-2 to R- 3 and
        therefore should increase efficiency.

The Original IDEX CA Prep Class

The Diversity within Design

The Interior Design Industry is so diverse; offering design professionals a wide variety of specialties to choose from. One area of concentration is Residential Renovation. Many Designers focus on a particular room of a home, such as the Kitchen or Bathroom(s) or specialize in one of many specific disciplines, such as Fung Shui, Lighting Design or Color Consultation. Other Designers will take a “whole house” approach.

The Cities, communities and homes we live in were built over the past 100 years and these homes don’t work any-more for us, today. The needs of our clients are not the same as they once were and older homes don’t fit our current lifestyles.

As a Home Renovation Designer, I create plans that correct the flow and function of the home as a whole, focusing on how the rooms relate to each other. Then I detail each of the rooms from a fit and function, point of view. Overall, finding the right way to change a home can be a challenge, especially when looking at a client’s need versus their budget.

Building expertise in focused areas allows a Designer to expand on the services they offer their client. Whatever path a Designer takes, the key to success is education and ongoing training.

As you know, our down economy has affected our industry tremendously, forcing many interior designers to either close or to down size to their home office. California legislation plays a very important part in the growth and demise of a business.

In order to keep the design community better informed we have our web site www.clcid.org and have set up a Linkedin, Facebook, Merchantcircle and Twitter accounts to expand communication with our members. We encourage you to sign-up for the ones that best serve you and your business.


Local Legislation

The CA state goal is for all homes built after January 1, 2020 is to be NZE (Net Zero Energy). In less than 8 years the building and energy codes will be transformed to achieve this legislative Goal. This Goal will affect all of us involved in the Interior Design Industry.

The following Bills were passed this year to accomplish this goal;

AB 758  –  Greater Energy Efficiency for existing residential and non-residential buildings.
AB 32  –  Codified the 2020 GHG (Greenhouse Gas Emissions) emission reductions targeted into law
AB 1109  – Established minimum energy efficiency standards for all general purpose lighting.
AB 1560  –  Requires the CEC to provide regulation for water efficiency in new RES & COMM  Buildings.

Establish the goal that new building standards achieve NZE by 2020 for residences & 2030 for commercial.
The CEC (California Energy Commission) is currently upgrading the 2008 Energy Standards to align with the 2013 triennial Code adoption process. The 2013 Energy Standards will be 30% from the NZE goal. Using the CALGreen Standards local jurisdictions have the ability to adopt the TIER 1 & TIER 2 codes in order to reach these goals. TIER 1 is 15% more efficient than the 2008 Energy Standard & the TIER 2 is 30% more efficient.

Design teams, in the next 8 years, will need to develop & integrate all the systems & components of a house in order to meet State goals: Super insulate & airtight, Use of none energy systems to provide heating & cooling, High performance windows & doors, Develop energy modeling software to determine NZE achievability.

IDCC (Interior Design Coalition of CA) has announced that they are planning on introducing a Bill next year that will impact all Interior Designers in the state of CA. We will keep a close watch on this legislation and will keep you up to date with the impact that it will have on your business.


National Legislation

H.R. 527, the Regulatory Flexibility Improvements Act of 2011, has just passed (Dec 1, 2011) in the House of Representatives. The Bill's intent is to improve the regulatory process by strengthening agency analysis of a rule's impact on small businesses. It will improve transparency and ensure that agencies thoughtfully consider the impact of regulations on small businesses. There are many Building and Design Associations watching this Bill so that unnecessary regulatory burdens won’t continue to impact the building and remodeling industry.

CLCID has updated and included the CALGreen codes for Interior Designers in their Codes and Regulations Resource Manual. This manual is a must have for the library of all Interior Designers. Go on to www.clcid.org and order yours today.

IDPC Alliance

This year CLCID has aligned with the Interior Design Protection Council (IDPC). IDPC is a national, non-partisan interior design business league working to protect the rights of interior designers to practice and to actively influence legislation that protects the livelihood of its members throughout the United States.

IDPC is spearheading the interior design "Freedom Movement," a collaboration of 28 national trade and stakeholder associations who work together across the country to protect design freedom. Since 2006, IDPC has successfully defeated over 100 bills in 21 states that would have expanded or enacted new protectionist, anti-competitive interior design regulations that would have put interior designers and industry allies out of work.

Aligning with IDPC will be a benefit to both associations whose mission it is to represent and protect the rights of ALL Interior Designers. http://www.idpcinfo.org/



Interior Design Legislation in California

CALGreen went into effect on January 1, 2011. Some building departments are adopting only the mandatory requirements other building departments are including Mandatory + some codes from Tier 1 and/or Tier 2. Always check, with the building department that you will be submitting your project, to know ahead of time what codes and regulations will apply.

Now, the State has created a webpage to post CALGreen adoption documents. You can access and research the local codes to determine the necessary compliance level for your project. Also, within these depository documents are the local amendments applicable for each city. Not every city or county has submitted their documents, but for those that have, you can find the information within this resource guide:

Gas Fireplaces

Gas Fireplace Clarification of code issues reported by the HPBA (Hearth, Patio and Barbeque Association) Pacific:
  • Cal-Green – The latest California building code has adopted the Green building standards that had been voluntary in the previous code cycle. For fireplaces this means ‘B’ Vent fireplaces will no longer be allowed under title 24. All gas burning fireplaces must be Direct Vent.
  • DOE – The US Department of Energy plans new rules for decorative gas appliances.
  • DOE passed a rule to limit non-heater rated gas fireplaces to 9,000 btu’s or less. This will be disastrous for many manufacturers and severely limit the gas fireplace options for builders and home owners. While there are many very beautiful heater-rated gas fireplaces available, some climate zones and some rooms are better off with a fire feature that does not produce a lot of heat.
  • HPBA is currently suing the Federal DOE over this rule.

Interior Design Legislation in the United States

This year, 18 bills have been introduced in the US that will affect the Interior Design Industry, the most ever. IDPC reported that “at ASID’s Annual Legislation Symposium in Colorado last October, their leadership (ASID’s) encouraged the attendees to introduce bills in all 50 states. They claim interior design should be licensed to protect the public's health and safety-yet there is not a shred of evidence to corroborate this claim.

Action to Date:
  • Arizona: HB 2309 would establish a Registered Interior Designer state title and restrict the submittal of plans for building permits to only those designers who are "Registered Interior Designers" (along with architects and engineers).
  • Colorado: Colorado Design Licensing Bill Rejected by Senate Business, Labor and Technology Committee by a Vote of 5-2.
  • Florida: House subcommittee passes recommendation to deregulate Interior Designers. The bill now moves on to the full House and then the Senate for passage.
  • Illinois: Practice Act withdrawn by sponsor
  • Massachusetts: HB 2999 would limit submittals on state projects to only NCIDQ certified interior designers-First Step toward Design Practice Act. A title act is still pending in the House (HB 262).
  • Mississippi: Governor Haley Barbour signed Title act bill HB 1096 into law.
  • New York: Senate Bill 5571- Interior Designer qualifications waiver to open up the membership for a period of 2 years to those designers who don't have the education, training and examination that, for over two decades, they (ASID) have insisted are necessary to demonstrate competence.
  • Oregon: House Bill 2491 - Interior Design Registration ("Licensing"). This law requires that anyone performing interior design services (with limited exceptions) to have a 4 year degree in interior design and pass the NCIDQ.
  • Pennsylvania: House Bill 1521 – Design Licensing - the House Professional Licensure Committee will hold a hearing on June 24th on HB 1521 which, if passed, would become the most restrictive and prohibitive design law in the country.

The fundamental question in dealing with occupational licensing is whether the law is necessary in order to protect the public from harm. Again, there is no evidence to substantiate that claim.



Small Business Jobs Act of 2010: Expanded 1099 Reporting

By now most business owners and independent contactors in the US are well aware of the new 1099 reporting requirements that were included in the 2010 Patient Protection and Affordable Care Act. This expansion of 1099 reporting, included to help cover the costs associated with the healthcare reforms, now requires businesses to issue the form 1099 to individuals and corporations providing more than $600 in goods and services in a calendar year. In the previous years 1099s only had to be issued to individuals and not to corporations.

This includes everybody and every business that you purchase $600 or more from, companies where you buy office supplies, gas, office furniture, raw materials. Every time you buy a new computer or a desk for your office YOU have to ask that company to give you a W9.

The general guideline is that you should not give a person or a business payment for goods or services until they give you a filled out and signed W-9 (name, address, and taxpayer identification number). so you can issue the person or company a 1099-Misc form.

Be sure and check with your accountant and the government website (http://www.irs.gov/pub/irs-pdf/i1099msc.pdf) in order to comply with the new regulations affecting your business.

Businesses are asking for a Repeal, both the U.S. House of Representatives and the U.S. Senate have passed legislation to repeal the 1099 but to date it has not passed both houses of Congress.



THE PURPOSE AND OBJECTIVE OF CLCID

The purpose and objective of CLCID is to promote the general professional welfare of all persons engaged in the business of interior design, to supply Government agencies with information and assistance in matters concerning the interior design industry and to publicize interior design-related legislation and administrative orders affecting the industry. It is the goal of CLCID to represent the industry in working with local, state, federal government agencies and officials and consumer groups and to acquire, preserve and disseminate valuable business information as it relates to the practice of interior design.

Our mission is to include all who are engaged in the Interior Design profession. We are continuing to reach out to our affiliates in other associations like NARI and NAHB. It is because of these affiliations we can be the voice of all legislation that affects the interior designers in the commercial and residential building industry in California.
